1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern your access to and use of the services provided by PeakPath Hong Kong Adventures (the “Company”, “we”, “us”, or “our”), a hiking service provider operating in Hong Kong.
By booking, purchasing, participating in, or otherwise using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any applicable booking confirmations, waivers, safety notices, and policies referenced herein. If you do not agree to these Terms, you must not use our services.
These Terms apply to all users, including individual customers, group participants, corporate clients, and any person accompanying a booking participant.
2. Scope of Services
PeakPath Hong Kong Adventures provides outdoor hiking and nature-based services in Hong Kong, which may include:
- Guided day hikes in Hong Kong;
- Private custom trail planning;
- Sunrise and sunset hiking tours;
- Corporate team-building hikes; and
- Family-friendly nature walks.
Our services may include route planning, guide accompaniment, general safety coordination, and related logistical support. Unless expressly agreed in writing, we do not provide emergency rescue services, medical services, transportation services, or insurance coverage.
We reserve the right to modify routes, schedules, meeting points, duration, or service format at any time where reasonably necessary due to weather, trail conditions, safety concerns, government restrictions, or other operational reasons.
3. User Obligations and Responsibilities
By participating in our services, you agree to comply with all instructions given by our guides, staff, or representatives. You are responsible for ensuring that you are physically and mentally fit to participate in hiking activities.
You must:
- Provide accurate, complete, and current information when booking;
- Disclose any relevant medical conditions, allergies, injuries, pregnancy, mobility limitations, or other circumstances that may affect your participation;
- Wear appropriate clothing and footwear suitable for hiking and weather conditions;
- Bring sufficient water, food, medication, sun protection, and any other personal items required for safe participation;
- Follow all safety instructions, trail rules, and applicable laws and regulations;
- Act responsibly and not engage in reckless, disruptive, unlawful, or unsafe conduct;
- Supervise minors under your care at all times, unless we have expressly agreed in writing to provide supervision;
- Refrain from participating if you are under the influence of alcohol, drugs, or any substance that may impair judgment or physical ability.
You acknowledge that hiking and outdoor activities involve inherent risks, including but not limited to slips, falls, dehydration, heat exhaustion, insect bites, wildlife encounters, adverse weather, trail hazards, and remote terrain. You accept responsibility for assessing whether participation is appropriate for you and any person under your supervision.
We may refuse participation or remove any participant from a service if, in our reasonable opinion, the participant poses a safety risk to themselves, other participants, staff, or third parties, or fails to comply with these Terms or our instructions. No refund will be due in such circumstances unless required by applicable law.
4. Payment Terms and Conditions
All prices, fees, and charges will be communicated at the time of booking or in a written quotation. Unless otherwise stated, prices are quoted in Hong Kong Dollars (HKD).
Payment terms may include one or more of the following:
- Full payment at the time of booking;
- A deposit with the balance due before the service date;
- Corporate invoicing subject to prior written agreement; or
- Other payment arrangements confirmed in writing by PeakPath Hong Kong Adventures.
Bookings are not confirmed until payment is received in full or the required deposit has been paid, as applicable. We may cancel or decline any booking if payment is not made by the required deadline.
You are responsible for any bank charges, card processing fees, foreign exchange fees, or other third-party charges associated with payment. If any payment is reversed, charged back, or disputed without valid cause, we reserve the right to suspend services, recover administrative costs, and pursue all available remedies.
Unless expressly stated otherwise, our prices do not include personal expenses, transportation, meals, insurance, or equipment rental.
5. Cancellation and Refund Policy
Because our services involve advance planning, guide allocation, and time-sensitive logistics, cancellations and refunds are subject to the following policy unless a different written policy applies to a specific booking:
- Customer cancellation more than 7 days before the service date: refund of amounts paid, less any non-refundable booking or administrative fees expressly disclosed at booking.
- Customer cancellation 3 to 7 days before the service date: partial refund may be provided at our discretion, taking into account committed costs and planning work already performed.
- Customer cancellation less than 72 hours before the service date: no refund, except where required by applicable law or where we agree otherwise in writing.
- No-shows or late arrivals causing missed participation: no refund.
If we cancel a service due to unsafe weather, trail closure, government restriction, insufficient participant numbers, guide unavailability, or other operational reasons, we will, at our discretion, offer one of the following:
- Rescheduling to an alternative date;
- A credit for future use; or
- A refund of the amount paid for the cancelled service, less any non-recoverable third-party costs already incurred and disclosed to you where permitted by law.
Refunds, where approved, will generally be processed using the original payment method within a reasonable period. We are not responsible for delays caused by banks, card issuers, or payment processors.
For private custom trail planning and corporate bookings, any non-refundable planning, consultation, or administrative fees will be disclosed in advance and may be retained even if the booking is cancelled, to the extent permitted by law.
6. Liability Limitations
To the maximum extent permitted by the laws of Hong Kong, PeakPath Hong Kong Adventures, its directors, officers, employees, guides, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive losses or damages, including loss of profit, loss of opportunity, loss of enjoyment, or loss of data, arising out of or in connection with your use of our services.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be excluded or limited under applicable law; or
- Any rights or remedies that cannot lawfully be excluded under the laws of Hong Kong.
Subject to the foregoing, and to the extent permitted by law, our total aggregate liability arising out of or in connection with any booking, service, or event shall be limited to the amount paid by you for the specific service giving rise to the claim.
You acknowledge that outdoor hiking activities carry inherent risks and that participation is voluntary. You are responsible for obtaining appropriate personal travel, medical, and accident insurance if desired. We do not provide insurance coverage for participants unless expressly stated in writing.
We are not responsible for loss, theft, or damage to personal property brought to any service, except to the extent caused by our proven negligence and not otherwise excluded by law.
7. Intellectual Property Rights
All content, materials, and intellectual property made available by PeakPath Hong Kong Adventures, including but not limited to text, photographs, route descriptions, maps, logos, branding, graphics, videos, itineraries, and website content, are owned by or licensed to us and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, publish, transmit, create derivative works from, or commercially exploit our content without our prior written consent, except where such use is permitted by law.
If you provide us with feedback, suggestions, testimonials, images, or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, and display such content for business, marketing, and operational purposes, unless you notify us in writing that you do not consent to such use and we agree otherwise.
You represent that any content you submit does not infringe the rights of any third party and that you have all necessary permissions for any material you share with us.
8. Data Protection and Privacy
We collect, use, store, and process personal data in connection with bookings, service delivery, safety management, customer support, and business administration. This may include your name, contact details, emergency contact information, health-related information you voluntarily disclose, payment information, and participation preferences.
We will handle personal data in accordance with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong and our privacy practices. We will take reasonable steps to protect personal data from unauthorised or accidental access, processing, erasure, loss, or use.
We may disclose personal data where necessary to:
- Process bookings and payments;
- Communicate with you regarding services;
- Ensure safety and respond to emergencies;
- Comply with legal obligations, court orders, or lawful requests by authorities;
- Engage service providers acting on our behalf under appropriate confidentiality obligations; or
- Protect our rights, property, safety, or that of others.
By providing us with personal data, including any health or emergency-related information, you consent to our use of that information for the purposes described above and for the safe delivery of our services.

9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to typhoons, heavy rain, extreme heat, landslides, trail closures, natural disasters, epidemics, pandemics, government action, civil unrest, strikes, transport disruptions, power failures, telecommunications failures, or other force majeure events.
In the event of force majeure, we may suspend, modify, or cancel services without liability, except to the extent required by applicable law or expressly stated otherwise in these Terms or a written booking agreement.
10. Changes to Terms
We may update or revise these Terms from time to time to reflect changes in our services, operational practices, legal requirements, or other business needs. The updated Terms will take effect upon posting or upon the date specified in the revised version, whichever is later.
Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.
For bookings already confirmed, the Terms in effect at the time of booking will generally apply unless the change is required by law or is necessary for safety, fraud prevention, or operational integrity.
11. Applicable Law and Jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
You agree that the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute, claim, or matter arising out of or in connection with these Terms, your booking, or your participation in our services, subject to any mandatory rights you may have under applicable law.

13. Severability Clause
If any provision of these Terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, lawful, and enforceable, or, if that is not possible, it shall be severed from these Terms.
The remaining provisions shall continue in full force and effect. Any failure by us to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
